Distance Sales Agreement

This distance sales agreement is prepared in accordance with consumer protection regulations.

1.2 BUYER INFORMATION
The educational institution or individual user accepting the contract is represented by the information specified in the order form.
2. Subject of Contract
The subject of this contract is the determination of the rights and obligations of the parties regarding the sale and delivery of the EduMoodUp education management platform service provided by the SELLER to the BUYER in electronic environment, in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.
3. Service Features
Service Name: EduMoodUp - Education Quality Monitoring and Analysis Platform
Service Scope:
- Emoji-based student satisfaction measurement
- AI-powered sentiment analysis
- Detailed performance reports
- Student, teacher, and institution-based statistics
- Real-time data analysis and dashboard
- Smart recommendation system
4. Payment Information
Total Amount: Determined according to your institution's number of students and usage intensity
Payment Method: Credit card, bank transfer/EFT
Billing Period: Monthly or annual (according to contract)
5. Service Start and Duration
The service is activated within 24 hours after payment approval. The subscription period is 1 month or 1 year according to the selected package. It automatically renews at the end of the period and continues unless cancelled.
6. Withdrawal Right
The BUYER can use the withdrawal right before the service begins to be performed. However, with the start of platform use, the service is considered to have been performed and the withdrawal right ends.
Withdrawal Right Duration: 14 days from the date the contract is established
Using the Withdrawal Right: To use your withdrawal right, it is sufficient to send an email to info@edumoodup.com
Consequences of Using the Withdrawal Right: If the withdrawal right is used, the entire paid amount is refunded to the BUYER within 14 days
7. Services Where Withdrawal Right Cannot Be Used
According to Article 15 of Law No. 6502, the withdrawal right cannot be used in the following situations:
- Services performed instantly in electronic environment or intangible goods delivered instantly to the consumer
- Services that begin to be performed with the BUYER's approval
8. Default and Legal Consequences
If the BUYER does not fulfill the payment obligation on time, they are obliged to pay default interest. If payment is delayed by 15 days, the service is suspended; if delayed by 30 days, the contract is terminated.
9. Resolution of Disputes
Turkish Law applies to disputes arising from this contract. Consumer Arbitration Boards and Consumer Courts are authorized in resolving disputes.
The BUYER can apply to district/provincial consumer arbitration boards within the monetary limits determined annually in December by the Ministry of Customs and Trade regarding the sale of the service subject to the contract.
10. Protection of Personal Data
The SELLER processes and protects the personal data of the BUYER within the scope of Law No. 6698 on the Protection of Personal Data. For detailed information, you can review the GDPR & Data Protection Notice.
11. Effectiveness
When the BUYER places an order through the platform, they are deemed to have accepted all conditions of this contract. The contract enters into force on the date it is approved by the BUYER in electronic environment.
